Usage OPTION: Type: Photoshoot and CGI Asset Usage: Entire library of assets. Unlimited, unrestricted, exclusive, in all areas of advertising, in all media, including non-commercial video and including all outtakes. BTS capture, Worldwide, in perpetuity for internal/promotional/awards use only. Media: All Media (excluding broadcast) Term: 2 years from first use date for photo assets Territory: North America only (digital/internet worldwide by nature) Note: In the event my performance is produced in the United States and should fall within the definition of Performer under the applicable SAG-AFTRA Commercials Contract, I agree to be bound by the terms and conditions (including exclusivity) of the applicable Contract and agree to accept scale rates. Further, I agree to sign a copy of the standard SAG-AFTRA Contract which Agency will furnish to me. ARTIFICIAL INTELLIGENCE (AI) USAGE: (a) Model acknowledges and agrees that in addition to the rights granted in the Model Release, Advertiser and the Licensed Parties may use Model’s image and likeness (including Model’s picture and on-camera performance or portrayal captured from the above-referenced Shoot) (collectively, “Model’s Image”) in generative AI tools or platforms (“Platforms”) in accordance with the terms of this Addendum. (b) Model acknowledges and agrees that Model’s Image may be uploaded to Platforms, provided that: (i) the Platform operates as a “walled garden” closed AI system, (ii) Model’s Image will be used in such Platform to create advertising and other materials solely for the above-named Advertiser/Product as further described below, and (iii) Model’s Image will not otherwise be used or stored in the Platform for machine learning purposes without Model’s prior written consent and if applicable, compensation. (c) Except as otherwise specified herein, all terms and conditions and obligations of Model set forth in the Model Release (including, without limitation, usage terms, ownership of advertising and other materials produced thereunder, and Model’s release of claims and waiver of liability, waiver of inspection or approval rights, no claim to additional compensation for use of advertising and other materials, and confidentiality) shall also apply to this Addendum and the materials produced under this Addendum. (d) In all other respects, the terms of the Model Release shall remain in full force and effect. Talent Exclusivity OPTION Exclusivity: 2 years from date of first insertion or 120 days from last shoot date, whichever comes first, in the following categories: Breast Cancer campaigns branded and unbranded from confirmed booking date/contract signing to end date of usage exclusivity term. Pre-negotiated Renewal Option: • One (1) Year Renewal Rate Beyond Expiry: Same Usage Terms; renewable as many times as client so wishes • Two (2) Years Renewal Rate Beyond Expiry: Same Usage Terms; renewable as many times as client so wishes RATES: HERO TALENT Fitting Fee: $250 + 20% AF Session Fee: $750 + 20 % AF Usage OPTION: $2,500 + 20% AF Exclusivity OPTION: $4,000 + 20% AF HERO RENEWAL OPTIONS Renewals are pre-negotiated for an additional 1 & 2 years at the rates below: Renewal Option: 1 Year North America $1,500 + 20% AF 2 Year North America: $2,500 + 20% AF Exclusivity Renewals are pre-negotiated renewals for an additional 1 & 2 years at the rates below: Exclusivity Renewal Option: 1 Year North America: $2,500 + 20% AF 2 Years North America: $4,500 + 20% AF SUPPORTING TALENT Fitting Fee: $250 + 20% AF Session Fee: $750 + 20 % AF Usage OPTION: $2,000 + 20% AF Exclusivity OPTION: $3,000 + 20% AF RENEWAL OPTIONS Renewals are pre-negotiated for an additional 1 & 2 years at the rates below: Renewal Option: 1 Year N.
