Talent Representative Terms of Use
Welcome to Casting Networks. These Talent Representative Terms of Use and any additional terms disclosed to you when you use our services (“Terms”) are a legally binding agreement between you and Casting Networks, LLC, its affiliates (collectively, “CN,” “we,” “our” or “us”) and its family of websites or other services that link to these Terms.
About Casting Networks, LLC
Casting Networks, LLC provides a range of content, hosting, communication and networking services, including content, features, functionalities and other services to allow Talent (as defined below) to connect with talent agents, managers, casting directors, and other professionals rendering professional services in motion picture, theatrical, radio, television and other entertainment enterprises (collectively the “Services”) that may be offered on our websites, mobile websites, apps, or from other services, products, tools, offers or communications provided by CN.
Applicability and Eligibility
These Talent Representative Terms of Use are only applicable to Talent Representatives who pay to access and use the Services.
Access to and use of the Platform and its services are in accordance with Section 3 of the Casting Networks Terms of Use.
These Talent Representative Terms of Use are restricted to professional Talent Representatives who are located in the United States.
Acceptance of Terms – Legally Binding Agreement
These Terms for Talent Representatives (the “Talent Representative TOU”) are incorporated into your Talent Representative Agreement (the “Agreement”) and serve as an addendum to and incorporate by reference the main Casting Networks Terms of Use (the “Casting Networks Terms of Use”) available at https://www.castingnetworks.com/terms/. In the event of any conflict, inconsistency or ambiguity between or among the Casting Networks Terms of Use and Talent Representative TOU, the Talent Representative TOU shall prevail.
You agree that when registering with CN and clicking or tapping “I Accept” (or similar such as the execution of an agreement through physical or electronic signature), or by accessing, viewing, downloading or otherwise using the Services, you are entering into a legally binding agreement with CN based on these Terms and our Privacy Policy, which is incorporated with these Terms. Additional Terms may be posted on some or all of the Services from time to time such as legal notices or rules for particular promotions, applications, or other features or activities.
Account Management and Responsibilities
The account owner is responsible for all activities conducted under the account, including ensuring the accuracy of all information provided, while the billing contact is responsible for timely payment of all invoices.
You may designate a separate billing contact for payment and invoicing purposes.
A Talent Representative user with access to multiple companies may have a different experience using the Services based on each company’s subscription status. When switching between companies, the features and access will reflect the status of the company you are currently viewing.
Fees and Billing information
Payment terms
ALL FEES ARE PAYABLE IN ACCORDANCE WITH THE PAYMENT SCHEDULE OUTLINED IN THE AGREEMENT. AFTER 1 YEAR AND EVERY YEAR THEREAFTER, YOUR CONTRACT WILL RENEW AUTOMATICALLY AND YOU WILL BE CHARGED YOUR PAYMENT METHOD ON FILE UNLESS YOU REQUEST CANCELLATION WITH A MINIMUM OF THIRTY (30) DAYS’ WRITTEN NOTICE PRIOR TO YOUR DESIRED CANCELLATION DATE.
BY USING THE SERVICES, YOU AUTHORIZE THE COMPANY AND ITS THIRD-PARTY PAYMENT PROCESSORS TO CHARGE ALL APPLICABLE FEES TO THE PAYMENT METHOD ON FILE IN ACCORDANCE WITH THE CASTING NETWORKS TERMS OF USE.
TO CANCEL YOUR SUBSCRIPTION, CONTACT https://support.castingnetworks.com/hc/en-us/requests/new. YOUR SUBSCRIPTION AND ACCESS TO THE SERVICES WILL BE TERMINATED THIRTY (30) DAYS FOLLOWING THE DATE OF YOUR CANCELLATION REQUEST. ANY PRE-PAID FEES COVERING THE PERIOD AFTER THE EFFECTIVE CANCELLATION DATE WILL BE REFUNDED ON A PRO-RATA BASIS.
Failed payments and unpaid accounts
If a payment fails, we reserve the right to attempt to re-process the payment. In the event of non-payment after all retry attempts have been exhausted, your access to the Services may be suspended, and you will not gain access until your account is once again in good standing.
Any in-progress processes, including but not limited to auditions, callbacks, or submissions, may become inaccessible. You cannot take further action on them until your company’s subscription is active.
If your account is unpaid and deemed inactive, casting directors may be unable to publish new projects to your account, although casting directors can still interact with existing submissions, schedules, media, and question requests that were submitted prior to the account becoming inactive. Casting Directors can still view and search for profiles associated with your company.
Talent associated with an inactive Talent Representative account will have the ability to continue to edit their profiles, access alerts, and reply to alerts, but they will not receive new responses from your account and its users until the account is active again.
Cooling-Off Period and Refunds
You may terminate this agreement within a cooling-off period of 10 days from the date of the executed Agreement, provided no services have been used. To exercise this right, you must notify in writing to https://support.castingnetworks.com/hc/en-us/requests/new.
All payments for services rendered are non-refundable. Refunds will only be considered in the event of a valid cancellation during the cooling-off period. We reserve the right to withhold a reasonable amount to cover administrative costs associated with any such refund.
